Surrey man sues BC Ferries in alleged shuttle bus accident

The incident happened in July 2009. Drew Robert Zyoba alleges he suffered a head injury and lost consciousness.

BC Ferries is being sued by a man who claims injuries from a Tsawwassen terminal shuttle bus accident. ADRIAN LAM, TIMES COLONIST

A Surrey man is suing the B.C. Ferry Authority, claiming he was thrown from a company parking lot shuttle bus at the Tsawwassen terminal on July 3, 2009.

The authority is responsible for BC Ferries and operates the system under contract to the provincial government.

In a notice of civil claim filed in B.C. Supreme Court June 29, Drew Robert Zyoba lists a John Doe as the employee who drove the shuttle.

Zyoba claims injuries resulting from:

  • negligence in proper vehicle use instruction;
  • failing to warn of shuttle use hazards;
  • failing to ensure shuttle occupants were properly seated and using seat belts;
  • failing to post warnings of shuttle use dangers;
  • failure to provide safeguards against people being thrown from the vehicle;
  • failing to have a proper occupant-monitoring system;
  • overloading the shuttle, and;
  • failing to call first responders after the incident.

Zyoba alleges he suffered a head injury with loss of consciousness, swelling and bruising to the right side of his head and a concussion. He alleges he continues to undergo medical care and has suffered loss of income and earning capacity as well as enjoyment of life.

He is seeking general and special damages as well as health-care costs.

BC Ferries spokesperson Astrid Chang said, "As this matter is before the court, we cannot comment."

None of the allegations have been proven in court.
